Agreement to Terms

By accessing or using Loquent ("the Platform"), operated by Monsoft Solutions ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

Description of Service

Loquent is an AI-first unified communications platform that provides voice calling, AI-powered call handling, real-time agent coaching, call recording and transcription, and multi-channel messaging. The Platform integrates AI capabilities to assist both autonomous and human-supervised communication workflows.

Account Registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must be at least 18 years old to use the Platform.
  • One person or legal entity may not maintain more than one account.

Acceptable Use

You agree not to:

  • Use the Platform for unlawful purposes, including illegal robocalling, harassment, or fraud.
  • Transmit any content that is defamatory, obscene, or infringes on the rights of others.
  • Attempt to gain unauthorized access to other accounts, systems, or networks.
  • Interfere with the Platform's operation or impose an unreasonable load on our infrastructure.
  • Resell or redistribute the Platform's services without our written consent.
  • Use the Platform in violation of any applicable telecommunications regulations.

AI Features & Limitations

Loquent incorporates AI-powered features. By using these features, you acknowledge:

  • AI is not perfect: AI-generated responses, transcriptions, summaries, and coaching suggestions may contain errors. You are responsible for reviewing and verifying AI outputs.
  • Disclosure requirements: When using autonomous AI agents to handle calls, you must comply with all applicable laws requiring disclosure that the caller is interacting with an AI system.
  • Consent for recording: You are responsible for obtaining appropriate consent for call recording in accordance with applicable local, state, and federal laws.
  • No guarantees: We do not guarantee specific outcomes from AI features, including call handling quality or coaching accuracy.

Billing & Payments

  • Paid plans are billed monthly or annually at the rate displayed at the time of purchase.
  • Usage-based charges (additional minutes, AI processing) are billed in arrears.
  • All fees are non-refundable unless otherwise stated or required by law.
  • We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any rate change takes effect.
  • Failure to pay may result in suspension or termination of your account.

Intellectual Property

The Platform, including its design, code, features, and documentation, is owned by Monsoft Solutions and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform.

You retain ownership of all content and communications you transmit through the Platform.

Limitation of Liability

To the maximum extent permitted by law, Monsoft Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Platform.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Platform may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

Termination

  • You may cancel your account at any time through the Platform settings.
  • We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice.
  • Upon termination, your right to use the Platform ceases immediately. Your data will be deleted within 30 days per our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Platform at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Miami-Dade County, Florida.
